This Acceptable Use Policy sets out who can't use 402pay, the businesses we don't support and the ways the Services may never be used. It applies to every business that uses the Services, and to everyone acting for one, and it forms part of our Terms of Service. You must follow it for as long as you use the Services.
The lists below are examples of what isn't allowed, not a complete list, and we may update them as laws, card network rules and risks change. If you're not sure whether your business is allowed, ask us at legal@402pay.co before you start accepting payments.
1Prohibited businesses
You may not use 402pay for any illegal activity, or to sell, promote or accept payments for:
- (a)drugs, drug paraphernalia, controlled substances and products made to imitate them;
- (b)weapons, ammunition, explosives and weapon parts;
- (c)unlicensed financial services, including money transmission, currency exchange, custody of other people's funds, and mixing or tumbling;
- (d)securities, investment schemes, pyramid and multi-level marketing schemes, and promises of guaranteed returns;
- (e)content that sexually exploits minors or depicts non-consensual acts;
- (f)products or services that involve or facilitate human trafficking or forced labor;
- (g)counterfeit goods, or anything that infringes a trademark, copyright, patent or other right;
- (h)stolen data or credentials, malware, and hacking or account takeover services;
- (i)content or services that promote violence, terrorism or hate; or
- (j)businesses that use deceptive, unfair or abusive practices, such as get-rich-quick schemes, fake reviews or subscriptions that are hard to cancel.
2Card payment restrictions
Card networks, and the independent providers that process card payments, have stricter rules than crypto. Even where crypto payments are allowed, we may not offer card payments for:
- (a)trading, investment and crypto products, including buying crypto or stored value to resell;
- (b)debt collection, credit repair and lending; or
- (c)nutraceuticals and other products with high dispute rates.
If you accept card payments, describe clearly what customers are buying, show your terms of sale at checkout, and keep your dispute rate below card network limits.
3Prohibited uses
Whatever your business, you must not use the Services, or try, to:
- (a)break any law that applies to you or your business, including export control, anti-money laundering and privacy laws;
- (b)launder money, finance terrorism or evade sanctions;
- (c)structure payments to avoid reporting obligations, or otherwise hide where funds come from;
- (d)give us false, manipulated or misleading information about who you are, who owns your business or what it does;
- (e)deceive customers, including with hidden fees or subscriptions that are hard to cancel;
- (f)charge customers, including AI agents, for goods, services or requests you don't deliver;
- (g)accept payments on behalf of another business without our written approval;
- (h)harass, abuse or harm anyone;
- (i)put the security of any account, wallet or key at risk, or obtain another user's credentials;
- (j)get around any measure that limits or protects access to the Services, or probe, scan or breach the security of any system or network;
- (k)send spam, scrape or crawl the Services, or place an unreasonable load on them;
- (l)decompile or reverse engineer the Services, or reach any part of them that isn't public;
- (m)resell or copy the Services, or use your access to build a competing product, without our written permission;
- (n)use our name, logo or marks in a way our brand guidelines don't allow, or imply an endorsement or affiliation that doesn't exist; or
- (o)open an account for anyone we have suspended or terminated.
4Your customers and users
You are responsible for how your checkout, payment links and integrations are used. Take reasonable steps to stop your customers and users from using them for anything this policy prohibits, and tell us if you learn that they have.
5Monitoring and enforcement
We review how the Services are used to keep them safe and lawful, and we decide, acting reasonably, whether a business or activity breaks this policy. A breach of this policy is a breach of the Terms of Service. If we reasonably believe you have broken it, we may flag, delay or block a checkout, payment link, payment method or account, ask you for information, suspend or end your access, and report the activity to the authorities where required.
We may act without notice where the risk or the law requires it, and the law sometimes prevents us from explaining a decision. We can't reverse transfers that have already confirmed on a network.
6Reporting a business
If you think a business is breaking this policy, email legal@402pay.co with the checkout or payment link involved and what you saw. We review every report.
7Changes to this policy
We may update this policy by publishing a new version here. We will tell businesses about changes that affect them, as the Terms of Service describe, and a business that no longer qualifies will have a reasonable time to stop, unless the law or the risk requires us to act sooner.
